Easing Frustrations with the Stark Law: CMS’ Proposed Regulations

Description: What do you do when you think there has been a breach of PHI? Are you really sure it was a breach? Could it have been a security incident? A privacy incident? What are the first steps you take to identify what occurred? Who needs to be notified? What do you do to resolve the problem? What if the incident involved a Business Associate? These and other questions and recommendations will be explored in this session with a Privacy Officer and a Security Officer.

Mike Newby serves as a partner in the firm. His practice focuses on business, regulatory compliance and other transactional issues within healthcare law. As providers continue to explore options to consolidate and affiliate, Mr. Newby has served as transaction counsel for hospitals, health systems and other providers in acquisitions, mergers, divestitures, member substitution agreements, joint ventures and other types of affiliations. Mr. Newby regularly advises physicians, dental professionals and other healthcare professionals on various employment contracts, buy-sell arrangements, corporate formation issues, and other transactional matters.
